These Terms & Conditions (Terms) govern your use of ComfyUIFlows Studio (Service), an advanced AI Image Generator and Virtual Try-On platform. By accessing or using our Service (including AI fashion photography, face swapping, custom model training, and AI product studio tools), you agree to these Terms.

1. Service Overview & AI Capabilities

ComfyUIFlows Studio provides access to computational AI image generation services, including but not limited to: Virtual Try-On mapping, AI Model Generation, Identity Face Swapping, High-Fidelity Object Rendering, 4K Image Upscaling, Ghost Mannequin garment simulation, and Custom LoRA Model Training.

2. Eligibility and Account Registration

Age requirement. You must be at least 18 years old to use our AI generation tools. By creating an account, you confirm you meet this requirement.

You must provide accurate information when registering for your AI fashion studio account.
You are responsible for all activity under your account, including generation history and API usage.
You must promptly notify us of any unauthorized account access.

3. Subscription Plans & Pricing

ComfyUIFlows Studio offers tiered subscription plans: Starter (500 credits/mo), Pro (2,000 credits/mo), Studio (8,000 credits/mo), and Team (20,000 credits/mo).
Each plan includes a defined set of AI tools, image storage quota, and processing priority level.
The Team plan includes collaborative workspace access, pooled credits across team members, and one (1) included Custom LoRA Model Training.
Subscriptions automatically renew at the start of each billing cycle. Upon renewal, your credit balance is reset to the plan's included amount.
Subscription Cancellation: You may cancel your subscription at any time. Upon cancellation, your plan benefits (including tool access and tier level) will be downgraded to the Free tier at the end of the current billing period. Any remaining unused credits in your account at the time of downgrade will remain available until consumed.
Plan Upgrades/Downgrades: You may change your subscription plan at any time. Upgrades take effect immediately. Downgrades take effect at the next billing cycle.
Prices and plan features may change at any time with prospective effect.

4. Credits, Commercial Usage, and Add-Ons

Running AI inferences (such as Virtual Try-On or 4K Upscaling) consumes digital Credits.
Commercial Rights: Users on paid subscriptions retain full commercial rights to the AI images they generate using our styling and processing tools, subject to these Terms.
Credits are digital units for in-platform computation only, are non-transferable, and have no cash value.
Pay-As-You-Go Credit Packs: Additional credits can be purchased as one-time add-ons (500 / 1,500 / 3,500 credits). These credits never expire and are added on top of your subscription credits.
Cloud Storage Add-Ons: Additional image storage slots (+25, +50, +100, +250, +500) can be purchased as one-time add-ons. Storage add-on slots are permanent and tied to your account.
Image Storage Limits: Each plan includes a base gallery storage limit (Free: 10, Starter: 25, Pro: 50, Studio: 100, Team: 300 images). When your storage is full, you must delete existing images or purchase a storage add-on to continue generating.

5. Custom LoRA Model Training

Team Plan Included Training: The Team subscription plan includes one (1) Custom LoRA Model Training at no additional cost.
Standalone Training Add-Ons: Users on any plan may purchase standalone LoRA training sessions: Face Model ($250), Style/Clothing LoRA ($350), or Team Training up to 5 faces ($800).
When you submit training data (images and captions), you grant us a limited license to process and temporarily store your dataset exclusively for the purpose of training your custom model.
Trained LoRA model files are made available for download for seven (7) days after completion. After this period, the files may be automatically removed from our servers.
You are responsible for downloading and backing up your trained model files within the availability window.
We do not guarantee specific training quality outcomes. The nature of AI model training is inherently variable.

6. Refunds

All purchases are final and non-refundable. See our Refund Policy for full details. Filing unjustified chargebacks or payment disputes will result in immediate and permanent suspension of your account.

7. Acceptable Use of AI Technologies

Do not use our Virtual Try-On or Face Swap services to generate non-consensual deepfakes, defamatory material, or illegal content.
NSFW & Nudity Penalty: Generating explicit nudity or NSFW imagery is strictly prohibited. If our automated safety filters detect an attempt to generate such content, your request will be blocked, and the credits associated with that request will be automatically deducted as a strictly non-refundable penalty.
Do not attempt to disrupt, probe, or reverse engineer our proprietary backend pipelines or AI models.
You must hold the necessary rights to any reference images you upload (e.g., target faces, source garments, or brand logos).

8. User Content & Source Images

You are responsible for the source photos (e.g., product flat-lays, model references) you upload and the generated AI outputs you create.
You represent that you have all rights necessary to process your uploaded reference imagery.
You grant us a limited license to process, host, and display content solely as needed to operate our AI rendering engine and secure the Service.

9. Intellectual Property

The ComfyUIFlows Studio software layout, proprietary prompt structures, backend API workflows, and site branding are owned by us and protected by intellectual property laws.

10. Service Availability

AI generation is computationally intensive. We may modify, suspend, or throttle access to specific tools (like 4K upscaling or heavy commercial processing) for network security, maintenance, or business reasons.

11. Disclaimers

The Service is provided AS IS. Given the unpredictable nature of generative AI, we do not guarantee perfectly photorealistic outputs or flawless text rendering on every generation attempt without warranties of any kind.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, revenue, goodwill, or business opportunities arising from your use of generated assets.

13. Indemnification

You agree to defend, indemnify, and hold harmless ComfyUIFlows Studio, its owners, officers, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the AI Service, (b) your generated content, (c) your violation of these Terms, or (d) your infringement of any third party's intellectual property or other rights.

14. Termination

We may suspend or terminate your access to the AI toolset immediately and without prior notice if you violate these Terms (e.g., generating prohibited content), create legal risk, engage in fraudulent activity, or misuse the Service. Upon termination, your right to use the Service ceases immediately. Sections regarding indemnification, limitation of liability, governing law, and dispute resolution survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States of America, without regard to its conflict of law provisions. To the extent any dispute involves federal law, the federal laws of the United States shall apply.

16. Dispute Resolution & Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall take place in Kalispell, Montana, or at your election, via telephone or video conference.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
JURY TRIAL WAIVER: You and ComfyUIFlows Studio each waive the right to a trial by jury in any legal proceeding arising out of or related to these Terms.
Exceptions: Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction for violations of intellectual property rights.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to comfyuiflowstudio@gmail.com within 30 days of creating your account. If you opt out, disputes will be resolved exclusively in the state or federal courts located in Flathead County, Montana.

17. DMCA & Copyright Policy

ComfyUIFlows Studio respects intellectual property rights under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on our platform infringes your copyright, submit a DMCA takedown notice to our designated agent at comfyuiflowstudio@gmail.com with: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good faith, and (e) a statement under penalty of perjury that the information is accurate.

18. Electronic Communications & E-SIGN Consent

By creating an account, you consent to receive electronic communications from us (e.g., emails, in-app notifications) and agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ComfyUIFlows Studio regarding the Service and supersede all prior agreements, representations, and understandings.

21. Changes to Terms

We may update these Terms from time to time to reflect evolving AI laws and business practices. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
